I am already gone. I realize how dumb state employees can be. Here is what happened.

I got pulled over towing my large flatbed trailer with a 24k load limit which makes it a Class A vehicle here in CA. I have a CLass A license so it is not a big deal. I was going to pick up a tree from a nursery for my house. The truck is a personal truck registered in my personal name, I use it for work and when I do I get reimbursed for my mileage just to keep that paper trail of it is not a work truck, it is on my personal insurance and registered to my house. The trailer I borrowed from my company and is registered and insured through the company. According to California law since I was not towing anything for compensation than I am exempt from all the commercial truck laws except I still need the proper license so I don't need to be registered in all the programs and permits unless I am using it for work. When I got pulled over it was for not having CA numbers on my truck and not having a weight sticker. The lady CHP then realized she could not do anything to me about the weight sticker and CA numbers because it was not a company truck and not being used for hire. Since the trailer was registered to a company she ran all the company stuff and found out the the company was not up to date on it's motor carrier permit ( I knew it was not but the DMV paperwork shows us as exempt because we don't have any big rigs, it was wrong). I get a ticket for not having a motor carrier permit and she puts the ticket in my personal name but puts the company address and puts the company as who my truck is registered to. I think she did this on purpose because she knew she could not legally give me that ticket. I argued with her for a while and she said it was because of Intent and that I could use it for hire and that was enough to give me the ticket.

I contact my local CHP motor carrier division and immediately they knew I was not supposed to get the ticket. I spoke with the head guy there who sent me an email with this in it to give to the judge.

Here’s some information on why you “should” be exempt from having to display anything on you dually. In section 34601 (b) CVC it states “transports property for hire” – You’re not.

Section 27900 CVC states “For Hire” in the signage requirements (Name / Trademark) – You’re not.

Section 34507.5 (a) CVC Defines what a Motor Carrier is. Also it states “ “For Hire” – You’re not.


I would stress the part that this is your personal vehicle. You were going to P/U a tree for YOUR property. You were not “hired or contracted” by anyone. I am also concerned about the word “Intent” the officer used. It’s supposed to be that an Officer can cite a violation during / while in the presence of that Officer. If they cite on “Intent” only, they would be able “post-date” a seat belt violation before it occurred!

Good Luck Sir. I’m sure the Judge will take into consideration that you were in your personal vehicle, not for hire.

In the meantime I still am having my company work on getting this motor carrier permit because it is obviously needed. It took me 4 months to get the permit, I had to enroll in a random drug test program for the state and a few other nonsense programs to get it. I go to court today with hopes of seeing a judge and explain why my ticket was no warranted. The lady behind the counter says it was written as a fix it ticket and I am not allowed to see the judge over it. I tried to explain to her how I was not driving commercially at the time and she argued that I was because it was written on the ticket that I was and there was nothing I could do about it. Finally I got fed up and just paid them and left.

It seems that the law is strong-arming people when they know damn well what the laws are and if they don't than they probably should not be enforcing them.

Why didn't you make a citizens arrest for her promoting prostitution? She obliviously has the equipment to do so and her INTENT was to **** over you, so, no brainer. Arrest her.
